Law of Government Commerce

This module considers the EU and international regimes governing government contracts. It commences with an introduction to the concept and economic importance of, public contracts. Examination of the (economics) argument for regulation - the agency problem; policy reasons for domestic regulation of public contracting; policy reasons for international and EU regulation. It examines international regimes such as WTO and UNCITRAL rules on procurement. It then focuses on the EU system for awarding public contracts from award procedure through to remedies.
