Speaker: Professor Tonio Borg, Faculty of Laws, University of Malta
Abstract
The subject of the lecture will examine different experiences in Malta and the United Kingdom regarding the resilience of the courts in thwarting attempts by the Executive or Parliament at restricting judicial review of actions of public authorities.
Prof. Borg will cover some salient judgments in both countries, and the courts’ thinking on clauses intended to oust court scrutiny, particularly the restrictive interpretation given to such legal provisions.
About the speaker
Born in Malta on 12th May 1957, Dr Borg’s legal and political career spans the past thirty years. Having graduated in Laws ''cum laude'' in 1979, he practiced and specialised as a human rights lawyer from 1980 – 1998.
Prof. Borg has been lecturing in public law at the University of Malta since 1989.
He is currently Associate Professor of Public Law and his field of expertise is human rights law, Maltese constitutional law, and court scrutiny of government’s actions under Administrative law.
He is widely published in these fields. In 2016, he published A Commentary on the Constitution of Malta, the first in depth study of the Maltese constitution and the only textbook on the subject. Its second edition was published in 2022.
Prof. Borg is also the author of Leading cases in Maltese Constitutional Law (2019), Judicial Review of Administrative Action in Malta (2020), Leading Cases in Administrative Law (2021), Maltese Administrative Law (2021), and The Blue Sisters Saga: A legal and factual analysis (2023).
Alongside his prestigious legal and academic work, Prof. Borg has also enjoyed an active political career. He was elected to the Maltese House of Representatives in 1992.
He served in the House for twenty years, and at worked as Minister for Home Affairs, Minister for Justice, and Minister for Foreign Affairs at various points between 1995 and 2012.
He held the office of Deputy Prime Minister between 2004 and 2012.
In November 2012, Prof Borg was appointed European Commissioner responsible for health and consumer policy a post which he held until the end of his term in October 2014.
