The rise and development of the Internet, big data and artificial intelligence have brought unprecedented challenges to legal regulation. But that doesn't mean it's an illegal place, and it needs to develop in a healthy and orderly way under the protection of the law. This topic starts from the current situation of China's data legislation, briefly introduces the main laws and regulations and policies of current data legislation, as well as international cooperation in data sharing, and analyzes the problems existing in China's big data legislation. At the same time, based on the author's work experience, this paper focuses on the data legislation of China's Customs, puts forward the weak points in the data legislation and legislation of China's Customs, and puts forward some ideas and countermeasures on how the Chinese government and China Customs can release the sharing dividend of data elements and enhance the new driving force of economic development under the premise of data security.
