In this presentation, Dr. Lingaas will focus on the contentious crime against humanity of apartheid, ranging from the crime's historical origins in South Africa to its inclusion in the Rome Statute of the International Criminal Court (ICC).
Why was the crime introduced into the Rome Statute despite not being included into any earlier drafts? Why did the inclusion find support when the Apartheid Convention, upon which it is based, was not ratified by any Western States and is considered a relic of the past?
The presentation reveals the unresolved legal complexities of the crime and tries to answer the question of whether it is conceivable that the situations in North Korea, Palestine and Myanmar meet the threshold of apartheid, meaning that individual perpetrators could be prosecuted for the crime of apartheid.’

Dr Carola Lingaas is an Associate Professor of Law at VID Specialized University (Oslo, Norway). Her research interests are in international criminal law, human rights law, and minority rights.
Apart from numerous book chapters and journal articles, she published the monograph 'The Concept of Race in International Criminal Law' (Routledge 2019).
She was educated at the University of Zurich (MA) and Oslo (LLM and PhD). Prior to joining academia, Carola worked for several years in the Red Cross (ICRC South Sudan and Norwegian Red Cross).
