International Energy Litigation

This course examines how international and cross-border disputes concerning energy materials and products can be settled. It is designed to provide a theoretical and practical understanding of energy related disputes and their resolution.

Principal topics to be covered include:
  • Dispute settlement under the Energy Charter Treaty, including both investor-state and state-to-state arbitration
  • The Dispute Settlement Understanding of the World Trade Organisation
  • The Trade Amendment to the Energy Charter Treaty
  • ICSID and UNICTRAL arbitration under bilateral investment treaties
  • Settlement of energy transit disputes; special focus on the 2009 Ukraine-Russia gas dispute
  • Compliance mechanisms
  • Oil pollution damage
  • Joint development zones of common hydrocarbon deposits
