On 17 June 2020, the European Commission issued its White Paper on levelling the playing field as regards foreign subsidies. This document suggests that foreign subsidies may distort the internal market and give rise to a regulatory gap. It proposes new powers which would enable the Commission to tackle the problem. This initiative should be viewed alongside the Foreign Direct Investment Screening Regulation 2016/1037 which will be applicable in its full scope in October 2020.
