State capitalism and industrial policies: towards a new protectionism in Europe?

Over the past years, many European member States have taken a significant number of economic steps that clearly fall within the traditional area of industrial policies, in order to face the consequences of the economic crisis. Moreover, additional mechanisms of public governance of the economy have been strengthened in various European countries in order to regulate foreign investments. However, some of these legal tools – such as golden shares/golden power – elevate relevant issues about the compatibility between national protection of strategic assets or companies and the European principle of free movement of capital and freedom of establishment.

In this seminar, Dr. Andrea Averardi, visiting fellow at The City Law School, City, University of London, will provide a critical analysis of national industrial and economic “defensive” measures, in order to understand whether their application can be considered not a transitional phenomenon but a permanent expression of a new form of European “State capitalism”.
